Terms and Conditions Flying Blue Store

By placing an order via the Flying Blue Store to purchase a book title of MarkMedia & Art you are accepting our Terms & Conditions. Please read these terms and conditions before placing an order.

By placing and submitting an electronic order via the FB Store, you are making an offer to purchase goods which, will result in a binding contract. A Miles balance check will be done before the order will be processed by MarkMedia & Art. Please note orders will only be dispatched once MarkMedia & Art have received authorization from Air France KLM.

MarkMedia & Art does not sell goods to children online. By using the Flying Blue Store to buy goods online, you confirm that you are at least 18 years old or, if you are under 18 years old, that you are accessing the website only with the consent and assistance of your parent or guardian. After you have placed your order, you will receive an email to acknowledge your order and confirm which goods you have ordered. Once the order has been processed, MarkMedia & Art will be sent a further email as confirmation that your order has been accepted and is due for dispatch. MarkMedia & Art is not obliged to accept your order and will not accept your order for reasons including but not limited to the following:

1). the goods are currently not in stock;

2). your payment is not authorized;

3). there is an error on the websites of Air France KLM or MarkMedia & Art (www.kingdombythesea.nl) regarding the Miles or other details of the goods;

4). or you have cancelled your order in the manner prescribed below (Cancelling Orders)

 

Delivery (Inter)national Orders

We will deliver goods to the address specified by you in the order process within 3 business days. Your purchase via the FB Store of Air France KLM includes VAT and/or Sales Tax and covers the costs of delivery to your address.

Standard delivery within the Netherlands is via Post NL and should take 1-2 days to arrive. International orders are sent through various courier companies and are trackable. MarkMedia & Art will provide you a track & trace number so you can follow your purchase. Delivery is based on availability, normal processing and delivery companies.

Delivery will be made as soon as possible after your order is accepted, at least within 3 business days. MarkMedia & Art cannot be held responsible for failure to deliver the goods if you have supplied incorrect information in the Flying Blue store; in circumstance whereby the goods will not fit into a letterbox and the address is unattended; or any other reason once the goods have been dispatched. If goods arrive in a damaged condition, if possible, make a note on the consignment note and inform MarkMedia & Art as soon as possible after the delivery. It is your responsibility to confirm that the correct number of packages, as indicated on the consignment note included with your goods, has been delivered. Any shortages must be noted on the consignment note and it will be your responsibility to notify us via info@markmedia.nl within 10 days from delivery after which you will become the owner of the goods you have ordered when the goods are dispatched to you from our distribution center. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk.

The customer is liable to pay all customs charges, import duties, taxes and postal clearance fees where applicable at the destination.

 

Cancelling Orders

If you change your mind after placing an order, you can cancel it at any time before we dispatch it. Please email info@markmedia.nl stating ‘Order Cancellation’. You will need to give us written confirmation of your name, address and your order number to cancel your order.

 

Product Availability, Pricing and Payment

Miles and availability are correct at the time of going to press but are subject to alteration without prior notice although we will endeavor to notify you. Please contact info@markmedia.nl if you have any queries about your order. If goods you have ordered are unavailable, you will be notified as soon as possible.

Prices throughout the FB website are quoted in miles and payment can only be accepted in miles. Books include 6% VAT or Sales Tax (where applicable). Packaging and delivery costs (where applicable) is included in the total amount of miles of your purchase.

 

Returns Policy

If you are not satisfied with the condition in which you have received our goods, then please notify us within 7 days after delivery by emailing info@markmedia.nl.

 

Upon written notification we will at – our option – exchange the goods;

1). make good any shortage or non-delivery;

2). or refund to you the amount of miles paid by you for the goods in question to the original method of payment. The shipping costs of returning the goods to our warehouse in the Netherlands are not refundable. To receive a refund, the book(s) must be returned in their original packaging, in an unbroken plastic seal and in the same condition in which they were received. If you wish to return goods you have a duty to keep them in your possession and to take reasonable care of them until you return them. Please note that our returns policy does not affect your consumer statutory rights.

 

General

MarkMedia & Art will not be liable to you for any indirect or consequential loss or damage arising out of any problem relating to goods delivered to you and shall have no liability to pay any compensation other than to refund you the amount paid for the goods upon their return. Please note that nothing contained herein limits any rights you have as a consumer under the laws of The Netherlands. Nothing in these terms and conditions creates any right which is enforceable by any person who is not a party to the contract between you, Air France KLM and MarkMedia & Art.

MarkMedia & Art shall have no liability to you for any failure to deliver the book(s) you have ordered or for any delay, damage or defect to goods delivered caused by circumstances beyond its reasonable control. If any part of these conditions is unenforceable (including any provision in which MarkMedia & Art excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

By placing an order in completing and submitting an electronic order via our website, you are making an offer to purchase goods which, if accepted by MarkMedia & Art, will result in a binding contract. MarkMedia & Art must receive payment of the whole price for the goods that you order before your order can be accepted. Please note orders will only be dispatched once we have received authorisation from your payment card issuer.

MarkMedia & Art does not sell goods to children online. By using the website to buy goods online, you confirm that you are at least 18 years old or, if you are under 18 years old, that you are accessing the website only with the consent and assistance of your parent or guardian. Please note that this email does not constitute an order acceptance from us and we reserve the right to refuse any order. Delivery

When you place your order you will be asked to choose the country of the destination of delivery. Standard delivery within the Netherlands is via Post NL and should take 1-2 days to arrive. Delivery is a trackable service.

Please place your order before 1pm to guarantee these delivery times. If you would like to place an express order after 1pm, please email info@markmedia.nl to see if your request can be dealt with. We will deliver goods to the address specified by you in the order process.

Delivery to international destinations

Delivery will be made as soon as possible after your order is accepted. All delivery times quoted on the web site are estimates only, based on availability, normal processing and delivery companies. MarkMedia & Art cannot be held responsible for failure to deliver the goods if you have supplied us with incorrect information; in circumstance whereby the goods will not fit into a letterbox and the address is unattended; or any other reason once the goods have been dispatched. If goods arrive in a damaged condition, if possible, make a note on the consignment note and inform us as soon as possible after the delivery. It is your responsibility to confirm that the correct number of packages, as indicated on the consignment note included with your goods, has been delivered. Any shortages must be noted on the consignment note and it will be your responsibility to notify us via info@markmedia.nl within 10 days from delivery after which you will become the owner of the goods you have ordered when the goods are dispatched to you from our distribution centre. Cancelling Orders

If you change your mind after placing an order, you can cancel it at any time before we dispatch it. Please email info@markmedia.nl stating ‘Order Cancellation’. You will need to give us written confirmation of your name, address and your order number to cancel your order. If you cancel part of an order the postage and packaging charge will be recalculated on the price of the goods you keep. Cancelled orders will be refunded in full, however this does not include any return shipping costs.
